Blue Sky Laws
Blue Sky Laws were developed in the early 1900’s to protect investors in the United States from fraudulent investments. These laws vary from state to state and are governed by state regulatory agencies. These agencies are responsible for the regulation and registration of all securities sales and offerings. In addition, these agencies also cover the registration and reporting requirements for broker dealers, investment advisors and individual financial representatives doing business in those states. It is important to note that every security sale or offering must be registered or be exempt from registration under the state’s blue sky laws prior to the offer or sale in that state. Registration in a state prior to an offering also applies to brokers, brokerage firms and issuers selling securities.
